- Having a noisy but peaceful patio
- Offering a happy hour promotion

Host liability refers to the civil and criminal responsibility of alcohol servers and licence holders when an over-served patron causes harm, such as a drunk driving accident. Ontario courts have consistently upheld this doctrine.
Question 3: A Smart Serve-certified server who over-serves a patron can face which of the following consequences?
- Only a verbal warning from management
- Personal fines, loss of certification, and civil liability (Correct answer)
- No consequences because the certification protects them
- Only the licence holder bears responsibility

Question 6: An intoxicated patron insists they are fine to drive. What is the best risk management strategy?
- Let them drive since they claim to be sober
- Offer to call a taxi or rideshare and, if they insist on driving, notify the police (Correct answer)
- Give them a coffee and send them on their way
- Ask other patrons to stop them physically
Correct answer: Offer to call a taxi or rideshare and, if they insist on driving, notify the police
Offering a safe transportation alternative and, as a last resort, contacting police demonstrates maximum duty of care. Physically restraining someone is not advisable and could create additional liability.
