CLI CLI Surveillance & Fieldwork Techniques 1 — Questions and Answers
Question 1: What is the primary legal requirement a CLI investigator must meet before conducting covert surveillance on a private individual in the US?
- Obtain a court order
- Have a legitimate, lawful purpose related to the investigation (Correct answer)
- Notify the subject in advance
- Register with the local sheriff's office
Correct answer: Have a legitimate, lawful purpose related to the investigation
US law requires that surveillance be conducted for a legitimate, lawful purpose; without this foundation, evidence gathered may be inadmissible and the investigator may face civil or criminal liability.
Question 2: Which legal doctrine protects individuals from surveillance in areas where they have a 'reasonable expectation of privacy'?
- The Plain View Doctrine
- The Fourth Amendment expectation of privacy standard (Correct answer)
- The Exclusionary Rule
- The Open Fields Doctrine
Correct answer: The Fourth Amendment expectation of privacy standard
The Fourth Amendment's reasonable expectation of privacy standard, established in Katz v. United States, determines whether surveillance constitutes a legal search.
Question 3: A CLI investigator conducting mobile surveillance observes the subject enter a private residence. What is the correct action?
- Enter the property to continue surveillance
- Use zoom equipment from a public vantage point (Correct answer)
- Trespass briefly to maintain visual contact
- Contact local police for immediate entry
Correct answer: Use zoom equipment from a public vantage point
Investigators must remain in public areas and may use zoom or telephoto equipment to observe subjects without trespassing on private property.
Question 4: When conducting stationary surveillance, what is the primary purpose of a 'cover story'?
- To deceive the subject being investigated
- To provide a plausible innocent explanation for the investigator's presence (Correct answer)
- To fabricate evidence
- To mislead law enforcement officers
Correct answer: To provide a plausible innocent explanation for the investigator's presence
A cover story gives the investigator a believable reason for being in a location without revealing the nature of the investigation to third parties.
Question 5: Which type of surveillance log entry is most critical for maintaining the evidentiary value of surveillance documentation?
- Subjective opinions about the subject's behavior
- Time-stamped, objective factual observations (Correct answer)
- Predictions about future subject behavior
- Hearsay statements from bystanders
Correct answer: Time-stamped, objective factual observations
Time-stamped, objective factual entries ensure the log is admissible in court and withstands cross-examination as a reliable contemporaneous record.
Question 6: Under US federal law, recording a phone conversation without the consent of at least one party is governed primarily by which statute?
- The Freedom of Information Act
- The Electronic Communications Privacy Act (ECPA) (Correct answer)
- The Computer Fraud and Abuse Act
- The Privacy Act of 1974
Correct answer: The Electronic Communications Privacy Act (ECPA)
